Questions we get a lot
If yours is not here, call the office and ask. Nobody minds the question.
General
What areas of law does Everett Law handle?
Civil matters, including family law, estate planning, guardianships, business formation, contracts, real estate, landlord matters, municipal law, and general civil litigation. If you are not sure whether your issue fits, get in touch and we will point you in the right direction.
Where is your office located?
265 S 3rd St in Batesville, Arkansas. We serve clients throughout North Central Arkansas and the surrounding communities.
Do you offer consultations?
Yes. A consultation is where we talk through your legal issue, explain your options, and work out whether this office is the right fit for what you need.
How much does a consultation cost?
It depends on the type of matter. Our staff will tell you the consultation fee when you call to schedule.
Do I need an appointment?
Yes. We see clients by appointment so we can give each matter our full attention.
What should I bring to my consultation?
Anything related to your case. Court papers, contracts, letters, photographs, financial records. If you are not sure whether something matters, bring it. We would rather have too much than not enough.
Do you accept walk-ins?
We are often in court, in meetings, or out of the office with clients. We strongly encourage scheduling appointments in advance. A walk-in may find no one available.
How quickly can I meet with an attorney?
As promptly as we can manage. It depends on the court schedule and the current caseload.
Hiring Everett Law
How much will my case cost?
Every matter is different. Some services are a flat fee, others are billed hourly and need a retainer up front. We go over fees and billing before representation begins so there are no surprises later.
Do you offer payment plans?
We generally ask for payment in full, but a payment plan may be possible on certain matters. Ask during your consultation.
When is payment due?
Unless we have agreed otherwise, payment is due when services are rendered or before work begins, depending on the type of matter.
Can you guarantee the outcome of my case?
No. No attorney can ethically guarantee a particular result in any case. What we will do is give you honest advice, keep you informed, and advocate for your interests at every stage.
Family law
Do I need grounds to get divorced in Arkansas?
Yes. Arkansas recognizes both fault-based and no-fault grounds. Worth knowing up front: irreconcilable differences is not a legal ground for divorce under Arkansas law. We will talk through which grounds apply to you.
Can I get custody if I was never married to the other parent?
Possibly. It depends on whether legal paternity has been established and on the facts of your case, including the fitness of each parent or guardian.
How long does a divorce take?
It varies. An uncontested divorce can move fairly quickly once the statutory requirements are met and both parties stay in agreement. A contested one can run several months or longer depending on the issues, how contested it gets, and the court's schedule.
Estate planning
Do I really need a will?
For most people, yes. A properly drafted estate plan helps make sure your wishes are carried out, and it makes probate easier on the people you leave behind.
What is the difference between a will and a trust?
A will directs how your property is distributed after your death. A trust can do more than that, both during your life and after it. Which one fits depends on your goals.
When should I update my estate plan?
After anything big. A marriage, a divorce, the birth of a child, buying property, or a significant change in your finances.
Business and real estate
Can you help me start a business?
Yes. Forming an LLC or another entity, preparing the operating agreement, and putting together the contracts and documents a new business needs to operate.
Can you review a contract before I sign it?
Absolutely, and it is usually much cheaper to review a contract before signing than to sort out a dispute after the fact.
Do you handle landlord-tenant matters?
Yes, though we generally represent landlords: lease preparation, notices, unlawful detainer actions, and other landlord-tenant issues.
Working with our office
How will we communicate about my case?
By phone, email, and a secure client portal where that makes sense. Email is our preferred method. We work at keeping clients informed as a case moves.
How long does it take to get a response?
We return calls and emails as promptly as we can. Court appearances, client meetings, and deadlines sometimes get in the way. If your matter is genuinely urgent, say so when you call.
What if my legal issue is outside your practice?
We will do our best to recommend another attorney or a resource that can help.
